Success in data protection claim over recall

In W -v- Secretary of State for Justice, the claimant was a man who had been sentenced to a time in prison. He was then released on licence. A probation officer misread a police entry on the ‘Niche’ system. She initiated a recall to prison on the incorrect basis that W had been arrested for a further offence whilst on bail. A judge sitting at Cardiff County Court upheld a claim under the Data Protection Act 2018, and awarded W compensation.
